Contr./Tri-State Date: Fri, 26 Jan 1990 10:12:00 -0500 RESOLUTION NO. 19004 A RESOLUTION TO AMEND RESOLUTION NO. 18928, ENCAPTIONED AS SET FORTH HEREIN, SO AS TO AMEND THE AMOUNT OF THE CONTRACT AWARDED TO SOLOFF CONSTRUCTION COMPANY AND THE AMOUNT OF THE CONTINGENCY FUNDS AND SO AS TO AUTHORIZE THE PAYMENT OF FUNDS FROM CONTINGENCY FOR ANY AUTHORIZED CHANGE ORDERS AND ANY INCREASE IN THE TOTAL CONTRACT AMOUNT RESULTING FROM ANY INCREASE IN THE BUILDING PREVAILING WAGE RATES ADOPTED BY THE STATE OF TENNESSEE AND FURTHER AUTHORIZING THE AWARD OF A CONTRACT TO ROBINSON ASSOCIATES CONSULTING ENGINEERS IN AN AMOUNT NOT TO EXCEED $19,000.00 FOR STRUCTURAL INSPECTION AND CERTIFICATION OF THE ENTRANCE ARCHES, PERFORMANCE ARCHES, SECURITY BUILDING, RESTROOM FACILITIES AND WATER WALL DISPLAY. _______________________________ WHEREAS, Resolution No. 18928, encaptioned, "A RESOLUTION AUTHORIZING THE AWARD OF THE ROSS'S LANDING PLAZA CONSTRUCTION CONTRACT TO SOLOFF CONSTRUCTION COMPANY FOR ITS LOW BID IN AN AMOUNT NOT TO EXCEED SIX MILLION TWENTY-SIX THOUSAND FOUR HUNDRED SIXTY-THREE AND NO/100 ($6,026,463.00) DOLLARS WHICH AMOUNT INCLUDES A CONTINGENCY OF $386,000.00 AND AN INCENTIVE BONUS OF $90,000.00 TO BE PAID IF EARNED, AUTHORIZING THE AWARD OF THE ROSS'S LANDING PLAZA TESTING SERVICES CONTRACT TO TRI-STATE TESTING AND DRILLING CO. FOR ITS LOW BID IN AN AMOUNT NOT TO EXCEED THIRTY-FIVE THOUSAND AND NO/100 ($35,000.00) DOLLARS, AND AUTHORIZING THE AWARD OF THE ROSS'S LANDING PLAZA CONTINUED DESIGN SERVICES CONTRACT TO EDAW, INC. FOR ITS PROPOSAL IN AN AMOUNT NOT TO EXCEED ONE HUNDRED THIRTY-EIGHT THOUSAND AND NO/100 ($138,000.00) DOLLARS, ALL OF WHICH IS TO BE PAID FROM GRANT FUNDS HERETOFORE RECEIVED FROM THE STATE OF TENNESSEE AND FROM PROCEEDS OF THE HOTEL-MOTEL TAX COLLECTED WITHIN THE COUNTY OF HAMILTON.", contained an inadvertent error in the total amount of the contract to be awarded to Soloff Construction Company; and WHEREAS, The City Council has been advised that the contingency fund should be reduced; and WHEREAS, The City Council has been advised that the Building Prevailing Wage Rates adopted by the State of Tennessee have been increased, that said increase will raise the total contract price and that it is advisable to pay for any increase in the Building Prevailing Wage Rates from contingency funds; and WHEREAS, The City Council has been advised of an inadvertent error in the aforesaid resolution concerning the award of a contract to Tri-state Testing and Drilling Co.; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CHATTANOOGA, TENNESSEE, That Resolution No. 18928, encaptioned as set forth above, be and the same is hereby amended by deleting the words and numbers "Six Million Twenty-Six Thousand Four Hundred Sixty-Three and no/100 ($6,026,463.00) Dollars which amount includes a contingency of $386,000.00 and" in the caption and body thereof and inserting in lieu thereof the words and numbers "Five Million Six Hundred Eleven Thousand Fifty-five ($5,611,055.00) Dollars which amount includes a negotiated change order for additional work in the amount of $269,955.00 and". BE IT FURTHER RESOLVED, That said resolution be and is hereby amended by adding an additional sentence at the end of the first paragraph thereof as follows: "There is hereby set aside the sum of $250,000.00 as contingency for payment of authorized change orders and for any increase in the total amount of the contract awarded to Soloff Construction Company resulting from the increase in the Building Prevailing Wage Rates adopted by the State of Tennessee." BE IT FURTHER RESOLVED, That Resolution No. 18928 is further amended by deleting the phrase "Tri-state Testing and Drilling Co. for its low bid" in the caption and body thereof and inserting in lieu thereof the phrase "Tri-state Testing and Drilling Co. for its negotiated proposal". BE IT FURTHER RESOLVED, That there be and is hereby authorized the award of a contract to Robinson Associates Consulting Engineers in an amount not to exceed $19,000.00 for structural inspection and certification of the Entrance Arches, Performance Arches, Security Building, Restroom Facilities and Water Wall Display to be paid from grant funds heretofore received from the State of Tennessee and/or from proceeds of the Hotel-Motel tax collected within the County of Hamilton.
